Heilbut, Symons & Co v Buckleton [1913] AC 30 is a leading House of Lords decision on misrepresentation in contract law. The Court held that an innocent misrepresentation gave no right to damages.


Background

Heilbut, Symons & Co. were rubber merchants who were underwriting shares of what they claimed was a rubber company. Buckleton called up a manager at Heilbut to inquire about the shares. In response to the questions, the manager stated that they were “bringing out a rubber company”. Based on this statement, Buckleton purchased a large amount of shares. The shares turned out not to be for a rubber company at all, the shares did very poorly. Buckleton sued for breach of warranty.

At trial the Court found that Heilbut made misrepresentation but was not done fraudulently. Nevertheless, at trial is was found that there was a warranty in the statement regarding the rubber company. The Plaintiff Buckleton succeeded at trial.


Opinion of the Court

For the Court, Lord Moulton identified two ways that the action could be successful. First, if the plaintiff could show fraudulent misrepresentation “or what is equivalent thereto, must be made recklessly, not caring whether it be true or not.”
Second, if there was intent (animus contrahendi) to be held to a promise then there may be a collateral contract, that would bind Heilbut to their representation. However, they are difficult to find, and, on the fact, none was found.

In conclusion, Moulton held:

It is, my Lords, of the greatest importance, in my opinion, that this House should maintain in its full integrity the principle that a person is not liable in damages for an innocent misrepresentation, no matter in what way or under what form the attack is made. In the present case the statement was made in answer to an inquiry for information. There is nothing which can by any possibility be taken as evidence of an intention on the part of either or both of the parties that there should be a contractual liability in respect of the accuracy of the statement. It is a representation as to a specific thing and nothing more.

ZIGZO (ジグゾ) is a Japanese Rock band that started activities in 1999 and disbanded in 2002. They were very popular in the Japanese indies scene.
After disbanding, reportedly due to musical differences, ZIGZO members have joined or formed other bands. Vocalist Tetsu formed NIL; guitarist Ryo and bassist Den formed TestNo and drummer Sakura joined Sons of All Pussys.

Call Admission Control prevents oversubscription of VoIP networks, CAC is a concept that applies only to real time media traffic and not to data traffic. CAC mechanisms complements the capabilities of QoS tools to protect voice traffic from the negative effects of other voice traffic and to keep excess voice traffic off the network.

Call Admission Control(CAC) is used to prevent congestion in Voice Traffic. It is a preventive Congestion Control Procedure. It is used in the Call Setup phase. CAC can be used to prevent congestion in connection-oriented protocols such as ATM. There are several CAC schemes available, which are detailed in [1].

It can also be used in VoIP in order to ensure there is enough bandwidth for the authorized flows. The difference between the former and the latter, however, is that VoIP uses RTP/UDP/IP, all of which are connectionless protocols. In this case, Integrated Services with RSVP (reserve resources for flow of packets through the network) using Controlled-Load Service is used in order to ensure that the call cannot be setup if it is not possible to support the flow described.

Also, according to the External link specified below, CAC kicks in to reject calls when either there is insufficient CPU processing power, or the Upstream/Downstream traffic exceeds prespecified thresholds, or the number of calls being handled exceeds a prespecified limit.

The Location Information Server, or LIS is a network node originally defined in the National Emergency Number Association network architecture that addresses the intermediate solution for providing e911 service for users of VoIP telephony. The LIS is the node that determines the location of the VoIP terminal.

Beyond the NENA architecture and VoIP, the LIS is capable of providing location information to any IP device within its served access network.


The Role of the LIS

The LIS is a service that is provided by an access network provider to provide location information to users of the network. To do this, it uses knowledge of network topology and a range of location determination techniques to locate devices that are attached to the network. The precise methods that are used to determine location are dependent on the type of access network and the information that can be obtained from the device.


Location Determination

The method used to determine the location of a device in an access network varies between the different types of networks. For a wired network, such as Ethernet or DSL a wiremap method is common. In wiremap location determination, the location of a device is determined by finding which cables are used to send packets to the device. This involves tracing data through aggregation points in the network (such as Ethernet switches, or DSL access nodes) and finding the port that packets for that device are sent to. This information is combined with data available to the LIS (usually extracted from a database) to determine a final location. How this tracing is done then depends on the type of network.

In wireless networks, a range of technologies can be applied to location determination, the most basic of which uses the location of the radio transmitter as an approximation. The actual method applied is similar to the wiremap method, if a radio transmitter can be identified, then the location of the device can be given as the position of the transmitter with an area of uncertainty.

A secure telephone is a telephone that provides voice security in the form of end-to-end encryption for the telephone call, and in some cases also the mutual authentication of the call parties, protecting them against a man in the middle attack.


How Secure Telephones work

The practical availability of secure telephones is restricted by several factors; notably politics, export issues, incompatibility between different products (the devices on each side of the call have to talk the same protocol), and high (though recently decreasing) price of the devices.


Well known products

The best-known product on the US government market is the STU-III family. However, this system has now been replaced by the Secure Terminal Equipment (STE) and SCIP standards which defines specifications for the design of equipment to secure both data and voice. The SCIP standard was developed by the NSA and the US DOD to derive more interoperability between secure communication equipment.


Privacy issues

The concerns about massive growth of telephone tapping incidents lead to growing demand for secure telephones. Several companies offer their products, eg. Dutch CryptoPhone, Slovak Silentel SecureCall, SecureGSM, or the secure telephone division of Siemens AG.


VOIP vs direct connection phones

As the popularity of VoIP grows, secure telephony is becoming more of commonplace and less the lonely domain of spies and civil libertarians.

Many major hardware and software providers offer it as a standard feature. What used to only be available at high expense and to a limited number of people is now freely available.

One of the most popular softphones is Skype, providing end-to-end encryption for PC-to-PC calls, though as it is closed-source, its security cannot be definitively verified.

Other examples include the Gizmo Project and Twinkle.

There are several manufacturers of hardware Analog Telephony Adapters such as Sipura/linksys and Snom which offer easy to use secure options.


Historically significant products

Products of historical significance are PGPfone and Nautilus (designed as a non-backdoored alternative to Clipper), and now officially discontinued (but continuing living on SourceForge) SpeakFreely, and the security VoIP protocol wrapper Zfone developed by the creator of PGP.

Other historical options involved scrambling generally using a form of voice inversion. This was available from electronic hobbyist kit suppliers and is common on FRS radios.

Analog scrambling products exist to this day because some telecommunications circuits, like HF links and telephone lines in the developing world — are of very low quality.

Internet Party Line - VocalTec

Internet Party Line (or simply iParty) was one of the first Internet telephony and conference software for Microsoft Windows. It was made by Intel and released as an experimental prototype in 1995. It featured a push-to-talk method of sending audio, in which each received audio clip was played in order without mixing, regardless of multiple people talking simultaneously. In this way, it addressed the problem of how to have an understandable group conversation in the face of large Internet latencies or low bandwidth.

Similar applications like iParty include Microsoft NetMeeting and VocalTec Internet Phone. Today Most of these older conference applications have been replaced by VoIP applications such as Skype.

The Voice Magazine - Voice

Student media at Athabasca University is provided by the official student publication The Voice Magazine. Previously printed and mailed to students across Canada, the magazine, since 2001, is published exclusively online in HTML and PDF format. It is the only student paper in Canada to be published exclusively online, and publishes more issues per year (49 in total) than any other member of the Canadian University Press (CUP). Readers may subscribe and receive email notification when each issue is released.

All submissions to the Voice are provided by freelance writers, most of whom are AU students. The website receives around 5000 visitors per month, and readers include AU undergraduates, graduate students, faculty and staff.

A yearly service of The Voice is the writing contest, which offers a scholarship prize of $500 for the best student submissions in each the fiction and non-fiction categories.

They are a member of the Canadian University Press.
